All purchases and use of the website is conditional to the acceptance of the terms and conditions. Any use of the website shows your acceptance of the Terms and Conditions.

We reserve the right to alter any or all of the Terms and Conditions from time to time and without notice and therefore the Terms and Conditions should be viewed before any use of this website. A date is shown at the top of the Terms and Conditions to show the last update.

Copyright:

The “Mollycoddled Pets” website, pictures, text, logos, website design and all intellectual knowledge and content is owned and operated by “Mollycoddled Pets Pty. Ltd.”. No individual or company may use this website for any other purpose other than purchasing goods. Except for actions permitted by the Copyright Act 1968 (Cth) no part of the website may be reproduced, adapted, performed in public or transmitted in any form by any process (graphic, electronic or mechanical, including further copying, recording, taping or by a storage and information retrieval system) without the specific prior written consent of Mollycoddled Pets Pty Ltd.


Product Orders:

Most orders received before 1pm AEST on a working day with payment processed and cleared will be shipped that day (see "Cheque Payments" below).  Any orders received after 1pm AEST, or on a weekend or public holiday will usually be shipped the next working day. If an order for any reason is not shipped within 3 working days of the order being made, or there is any unavoidable delay to the shipping, or one parts of the order is unavailable, an email will be sent advising of such. If the order is not shipped within that time due to unavailable stock, the customer can decide to cancel that item and the remaining items will be shipped accordingly, with an appropriate refund by cheque or credit card for the unavailable item being made taking into account any change to shipping costs. If the customer does not respond to the email before the item becomes available, then the order will be shipped and the offer of a refund will be withdrawn. If the customer decides to have the available items shipped, with the later shipment of the unavailable item once it becomes available again, there may be an additional shipping charge. Any delay to order shipment caused by the actions of the customer, such as to arrange a specialised courier service or arrange insurance, etc. will remove any previously stated offer of refund.


Prices/Currency:

All product prices are in Australian dollars. Any conversion of Australian dollars into any other currency or visa versa is not guaranteed by Mollycoddled Pets, and all charges will be in Australian dollars. Any fluctuation in currency is out of the control of Mollycoddled Pets and Mollycoddled Pets will not be responsible for any delays in processing payments.

Note that as we have no control over this site and because currency can fluctuate at any time, we cannot be held responsible for price differences between when the product is ordered and when the charge is processed.


GST (Goods and Services Tax):

All Prices displayed are inclusive of Australian GST applied at the rate of 10%. All shipments to an address outside Australia and its Territories will have the GST component removed.


Credit Card:

Whilst Mollycoddled Pets prefers all payments to be made by credit card, we do take credit card fraud very seriously and any fraudulent use of a credit card will be reported to the relevant authorities.

This includes providing invalid or deliberately incorrect credit card information. All cases of providing such information will be reported to the relevant authorities.

Signatures may be required upon receipt of product.

Additional proof of identity may be requested by Mollycoddled Pets at any time.

Ltd. does not declare that any information on this website including files, pictures, logos, any links to other websites, files (etc.), or any other part of this website or linked website is free from Viruses, Trojans, defects, or any other faults. It is wholly the responsibility of anyone using this site to ensure to scan for viruses or other faults. Mollycoddled Pets Pty. Ltd. will not be liable in any way to any damage or loss (whether direct, indirect, consequential or economic) caused by the use of this website however that damage be caused and whether or not that damage is caused by negligence.

Any information found on this website including but not limited to links from this website is of a general nature only and may not be applicable in all circumstances. Mollycoddled Pets Pty. Ltd. does not take responsibility any misinterpretation, misunderstanding, misapplication, or other use or misuse of information found on this website or links from this website. Mollycoddled Pets Pty. Ltd. will also not take any responsibility for any information supplied by third parties in relation to any products or advice found on this website, even in the circumstances that Mollycoddled Pets Pty. Ltd. refers you or others to that third party. All pet health matters should be referred a qualified veterinary professional.


Capacity:

The products available on this website are only available for sale to persons who are capable of making legally binding contracts. The products are not available to anyone under the age of 18 year and any other person who are legally prohibited from entering into binding contracts.


Cheque Payments:

Cheque Payments are only available via Mail Order unless otherwise agree beforehand. Orders will not be sent until the cheque payment has cleared. Any cost incurred by us for cancelled or uncleared cheques will be charged back to the customer.


Delivery:

All shipments are made by Australia Post. All risk to the shipment will be passed to the customer once the items have been collected by Australia Post or other courier and when the item has been delivered.

Optional Insurance can be obtained by contacting Mollycoddled Pets via email before the order is shipped and appropriate payments received. Insurance will not be granted until all payments including that for insurance have been made.

If the customer wishes, other courier services can be arranged with any extra costs incurred by Mollycoddled Pets being charged to the customer. These charges may include not only the courier costs but also any time needed for Mollycoddled Pets to arrange the customers’ request.

Any delivery times mentioned on this website are estimated only and no responsibility will be taken by Mollycoddled Pets for their accuracy.


Title:

All products remain the property of Mollycoddled Pets until full payment has received by Mollycoddled Pets.


Risk:

All risk to the products is taken by the customer product has left the Mollycoddled Pets premises as stated in the Delivery Terms and Conditions.


Refunds and Exchanges:

Refer to Refund Policy.


International Shipment:

At the moment all International orders can only be taken by Mail order or Fax order. Mollycoddled Pets will inform the customer by email of shipping costs and estimated delivery times. Mollycoddled Pets will not take responsibility for any delays in shipping, or any costs due to product breakages if shipping insurance is not taken out. All International Shipments must be signed for by the credit card holder, or otherwise if cheque payment is made.


Limitation of Liabilities:

Mollycoddled Pets Pty. Ltd. will in no way be held liable for any damage, whether that be direct, indirect, incidental, or otherwise, resulting from the use of any products sold or otherwise obtained from Mollycoddled Pets Pty. Ltd. Mollycoddled Pets. Pty. Ltd. will also not be held liable for any loss in earnings, inability to replace product, changes to specification to products by manufactures, or other product alterations either known or unknown to Mollycoddled Pets Pty. Ltd.  


Jurisdiction:

All dealings with Mollycoddled Pets Pty. Ltd. and this website, including all Terms and Conditions are constructed in accordance with the laws of the state of Victoria, Australia. Any use of this website means that you agree to the non-exclusive jurisdiction of the courts of the state of Victoria, Australia.
